Terms and Conditions

WP Static Shield from Tulapp

These Terms and Conditions ("Terms") govern your access to and use of WP Static Shield from Tulapp, including any software, plugins, hosted services, dashboards, APIs, remote services, integrations, monitoring, security functionality, performance functionality, management tools, updates and related services made available by Tulapp (collectively, the "Service").

By creating an account, installing or activating software, connecting a website, using hosted functionality, purchasing a subscription, or otherwise using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.


1. Provider

The Service is provided by Tulapp, a trade name of ClickSmash B.V., registered in the Netherlands under KVK number 93178085 (VAT NL866302566B01), registered address Grote Sparrenlaan 3, 2121 CZ Bennebroek, The Netherlands.

References to "Tulapp", "we", "us" or "our" include ClickSmash B.V. and, where legally relevant, its employees, contractors, developers and licensors.


2. Nature of the Service

The Service provides software and online functionality intended to assist users in operating, managing, optimising, protecting, monitoring, publishing or otherwise working with websites and related technical infrastructure.

The Service may include local software, hosted functionality, automated processes, remote services, third-party integrations and other technical features.

Available functionality may differ depending on:

  • the version of the Service;
  • the selected plan or subscription;
  • the user's website or infrastructure;
  • software compatibility;
  • technical limitations;
  • region;
  • third-party availability;
  • experimental or beta status.

Tulapp may add, modify, replace or discontinue functionality over time.


3. No Guarantee of Security

The Service may include functionality intended to improve security, reduce exposure, identify risks or help users manage technical systems.

No software or security measure can guarantee complete security.

Tulapp does not guarantee that the Service will:

  • prevent every attack;
  • detect every vulnerability;
  • prevent malware or unauthorised access;
  • prevent data loss;
  • prevent downtime;
  • make outdated or vulnerable software inherently secure.

Security-related scores, statuses, warnings, classifications and recommendations are informational tools and not guarantees.

You remain responsible for the security and management of your systems.


4. Use at Your Own Risk

You use the Service at your own risk.

The Service may interact with, modify or influence technical components of your website or infrastructure.

Depending on configuration, this may affect matters such as:

  • website availability;
  • routing;
  • caching;
  • files;
  • configuration;
  • access controls;
  • deployment;
  • integrations;
  • server behaviour;
  • content delivery;
  • administrative access.

Software defects, configuration errors, incompatibilities, third-party changes or unexpected technical conditions may cause a website or part of a website to malfunction or become unavailable.


5. Backups

Before using functionality that may affect a website, configuration, files, database, access controls or infrastructure, you must maintain an appropriate and restorable backup.

You are responsible for:

  • creating backups;
  • keeping backups current;
  • protecting backups;
  • verifying that backups can actually be restored;
  • maintaining sufficient access to perform a restoration.

Where the Service asks you to confirm that a backup exists, Tulapp does not independently verify that the backup is complete or restorable.

Unless expressly agreed otherwise in a separate service agreement, Tulapp is not responsible for maintaining backups on your behalf.


6. Recovery Responsibility

You must maintain sufficient technical or administrative access to recover your website or infrastructure if something goes wrong.

This may include access to hosting, files, databases, DNS, server management tools, backup systems or other relevant infrastructure.

Do not activate technical functionality if you are unable to recover from an unsuccessful configuration change or deployment.


7. Legacy and Unsupported Software

The Service may support older or outdated software in certain circumstances.

Compatibility with outdated software does not mean that such software is safe, supported by its original vendor, or free from vulnerabilities.

The Service may reduce certain forms of exposure, but users remain responsible for updating, replacing, patching or otherwise maintaining outdated software where reasonably possible.


8. Compatibility

The Service operates in technical environments that may contain software and services outside Tulapp's control.

Tulapp therefore does not guarantee compatibility with every:

  • website;
  • plugin;
  • theme;
  • extension;
  • server;
  • hosting provider;
  • operating system;
  • programming language version;
  • external platform;
  • integration;
  • configuration.

Compatibility information provided by the Service may be based on testing, observed behaviour, known technical information, aggregated data or automated analysis.

Such information is provided as guidance and does not constitute a warranty.


9. Testing Before Production Use

You are responsible for testing important functionality before relying on it in production.

Where the Service provides preview, validation, staging, rollback or similar functionality, such tools are intended to reduce risk but do not eliminate the need for appropriate testing and backups.


10. Account

Some functionality may require a Tulapp account.

You are responsible for:

  • providing accurate account information;
  • maintaining access to your registered email address;
  • protecting your credentials;
  • keeping authentication methods secure;
  • preventing unauthorised access;
  • notifying Tulapp promptly if compromise is suspected.

11. Account Verification and Recovery

Tulapp may require account or email verification.

We may provide account, password or access recovery mechanisms.

Recovery mechanisms are provided as a convenience and security measure but cannot be guaranteed to work in every technical situation.

You remain responsible for maintaining independent access to systems you manage.


12. Remote Management and Access Controls

The Service may allow users to remotely configure or manage connected websites or infrastructure.

Where remote access controls or restrictions are used, configuration changes may affect your ability to access your own systems.

You are responsible for reviewing and maintaining appropriate recovery options.

Tulapp does not guarantee that remote recovery will always be possible.


13. Access Restrictions and Changing Networks

Where access controls depend on network addresses, devices, authentication state or similar technical characteristics, changes in those characteristics may affect access.

For example, internet providers, mobile networks and VPN services may change IP addresses.

The Service may provide mechanisms to update or recover access, but you should maintain an independent recovery method where reasonably possible.


14. Hosted Services

Certain parts of the Service may be hosted by Tulapp or third parties.

Hosted services may process technical information required to provide functionality.

Availability may depend on:

  • network connectivity;
  • hosting infrastructure;
  • third-party providers;
  • maintenance;
  • security events;
  • circumstances beyond Tulapp's reasonable control.

Tulapp does not guarantee uninterrupted availability.


15. Local Functionality and Service Availability

Where technically possible, functionality deployed locally to a customer's website or infrastructure may continue operating independently of Tulapp-hosted services.

However, this is not guaranteed for every feature or configuration.

An outage of Tulapp-hosted services does not create an obligation for Tulapp to expose, disable or reconfigure a customer's underlying systems.


16. Technical Measurements and Estimates

The Service may provide statistics, measurements, scores, comparisons, forecasts or estimates relating to matters such as performance, resource usage, security, compatibility or system behaviour.

Some values may be directly measured.

Others may be estimated, sampled, modelled or derived from baseline measurements.

Estimated figures are not exact measurements and should not be relied upon as guarantees of:

  • cost savings;
  • capacity;
  • performance;
  • security;
  • availability;
  • future behaviour.

17. Automated Analysis

The Service may use automated analysis to identify technical characteristics, changes, potential risks, compatibility issues or recommendations.

Automated findings may contain errors, false positives or false negatives.

Users should review important findings before taking consequential action.


18. Data Protection and Privacy

Tulapp processes personal data in accordance with applicable privacy and data-protection laws, including the General Data Protection Regulation ("GDPR") where applicable.

Detailed information about personal-data processing is provided in the separate Privacy Policy.

Acceptance of these Terms is not used as a substitute for consent where consent is legally required.


19. Controller and Processor Roles

Depending on how the Service is used, Tulapp may act as:

  • an independent data controller for account, administration, security, billing and service-operation data; or
  • a processor acting on behalf of a customer where Tulapp processes personal data solely under the customer's instructions.

Where legally required, processor activities will be governed by a separate Data Processing Agreement.


20. Data Minimisation

Tulapp aims to process only information reasonably necessary to provide, secure, improve and administer the Service.

Where practical, technical information may be represented using:

  • hashes;
  • identifiers;
  • aggregate measurements;
  • counts;
  • technical metadata;
  • normalised values

instead of unnecessary raw customer content.

The Privacy Policy provides further detail.


21. Customer Data and Content

You remain responsible for data and content processed through systems you connect to the Service.

You represent that you have the necessary rights and legal basis to process such data.

You are responsible for compliance with laws applicable to your website and business, including where relevant:

  • privacy law;
  • consumer law;
  • electronic communications rules;
  • intellectual-property law;
  • accessibility requirements;
  • marketing law;
  • sector-specific requirements.

22. International Users

The Service may be used internationally.

Users are responsible for complying with mandatory laws applicable in their jurisdiction.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

This includes, where applicable, mandatory laws in jurisdictions such as:

  • the European Union and European Economic Area;
  • the United Kingdom;
  • the United States;
  • Australia;
  • Canada;
  • Switzerland;
  • New Zealand;
  • other countries in which the Service is lawfully used.

23. Consumer Rights

If you use the Service as a consumer, statutory consumer rights remain unaffected.

Nothing in these Terms is intended to waive or restrict rights that cannot lawfully be waived or restricted.

If a provision conflicts with mandatory consumer law, the mandatory law prevails.


24. Australian Users

If the Australian Consumer Law applies, nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot legally be excluded, restricted or modified.

Any limitation in these Terms applies only to the extent permitted by law.


25. United States Users

Certain United States jurisdictions restrict the exclusion of warranties or limitation of liability.

Where such laws apply, the exclusions and limitations in these Terms apply only to the maximum extent permitted by applicable law.


26. Subscriptions and Paid Services

Certain functionality may require a paid subscription or other payment arrangement.

Current pricing is published at tulapp.com/pricing. Applicable prices, billing periods, included functionality and renewal terms will be communicated before purchase, and the price for the upcoming renewal is shown before you pay.

Paid subscriptions are billed annually and renew automatically at the end of each billing period unless cancelled before the renewal date. See the Refund and Cancellation Policy for how to cancel and what happens to your access afterwards.

Payments are processed by Mollie B.V., an independent third-party payment service provider — see section 30 and the Privacy Policy.

Functionality associated with a subscription may change over time as the Service evolves, subject to applicable law and any specific contractual commitments made at purchase.


27. Expiration or Cancellation of Paid Services

When a paid service expires or is cancelled, access to subscription-dependent functionality may end. Cancelling stops future renewal only — access already paid for continues until the end of the current paid period; see the Refund and Cancellation Policy for the full detail.

Tulapp will not intentionally make an already deployed customer's website unavailable solely because a subscription expires.

However, functionality that relies on ongoing hosted services, remote services, intelligence, monitoring, updates or similar subscription-dependent resources may no longer be available.

You remain responsible for maintaining appropriate local access and recovery capabilities.


28. Changes to the Service

Tulapp may develop and change the Service continuously.

This may include:

  • adding functionality;
  • changing functionality;
  • replacing functionality;
  • changing technical architecture;
  • modifying integrations;
  • changing technical requirements;
  • discontinuing functionality.

Tulapp may also release experimental, beta or preview features.

Material changes to paid services will be handled reasonably and in accordance with applicable law.


29. Beta and Experimental Features

Some functionality may be identified as:

  • beta;
  • preview;
  • experimental;
  • early access;
  • legacy support.

Such functionality may be less stable, less tested or subject to greater change.

You should use additional caution and maintain appropriate backups when using such features.


30. Third-Party Services

The Service may interact with third-party software and services, including Mollie B.V., our payment service provider, which processes payments on Tulapp's behalf. Tulapp does not collect or store your card or bank details — see the Privacy Policy.

Tulapp is not responsible for third-party:

  • availability;
  • security;
  • performance;
  • compatibility;
  • changes;
  • pricing;
  • conduct;
  • legal terms.

Third-party terms may apply separately.


31. Acceptable Use

You may not use the Service:

  • unlawfully;
  • to gain unauthorised access to systems;
  • to interfere with systems you do not own or control;
  • to distribute malware;
  • to attack Tulapp infrastructure;
  • to circumvent authentication or subscription controls;
  • to violate third-party rights;
  • to perform abusive or unauthorised scanning;
  • to overload or disrupt the Service.

Security-related functionality may only be used against systems you own or are authorised to manage or test.


32. Intellectual Property

Tulapp and its licensors retain all intellectual-property rights in the Service except for third-party components governed by their own licences.

You receive a limited, non-exclusive and non-transferable right to use the Service in accordance with these Terms and any applicable subscription or licence.

No ownership rights are transferred.


33. Open-Source Components

The Service may contain open-source software.

Open-source components remain subject to their applicable licence terms.

Where an open-source licence grants rights that differ from these Terms, that licence governs the relevant component.


34. No Professional Advice

Information, scores, recommendations and automated findings provided by the Service are technical information only.

They do not constitute:

  • legal advice;
  • formal cybersecurity certification;
  • compliance advice;
  • financial advice;
  • insurance advice.

Seek appropriate professional advice where necessary.


35. No Warranty

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available."

Tulapp does not warrant that:

  • the Service will be uninterrupted;
  • the Service will be error-free;
  • all defects will be corrected;
  • all threats will be detected;
  • all attacks will be prevented;
  • all integrations will remain compatible;
  • all data will remain available;
  • any specific performance improvement will be achieved;
  • any technical recovery mechanism will always work.

Mandatory statutory warranties remain unaffected.


36. User Responsibility

You remain responsible for:

  • your websites;
  • infrastructure;
  • hosting;
  • data;
  • backups;
  • users;
  • credentials;
  • configuration;
  • connected third-party services;
  • compliance obligations;
  • deciding which functionality to use;
  • reviewing results after technical changes.

37. Limitation of Liability

To the fullest extent permitted by applicable law, Tulapp and its creators, developers, employees, contractors and licensors are not liable for indirect, incidental, special, consequential or punitive damages, including loss of:

  • profit;
  • revenue;
  • business;
  • opportunity;
  • goodwill;
  • data;

or losses caused by:

  • downtime;
  • security incidents;
  • failed configuration;
  • restoration work;
  • third-party services;
  • technical incompatibility.

38. Maximum Liability

To the fullest extent permitted by applicable law, Tulapp's total aggregate liability arising out of or relating to the Service is limited to the amount paid by the customer to Tulapp for the affected Service during the 12 months preceding the event giving rise to the claim.

For free Services, liability is limited, to the fullest extent permitted by law, to EUR 100.

This limitation does not apply where applicable law does not permit liability to be excluded or limited.


39. Non-Excludable Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by mandatory law.

This includes liability that cannot legally be excluded for matters such as intentional misconduct, fraud or other non-excludable liability.


40. Business Indemnification

If you use the Service for business or professional purposes, you agree, to the extent permitted by law, to indemnify Tulapp against third-party claims resulting from:

  • unlawful use of the Service;
  • systems used without authorisation;
  • unlawful customer content or data;
  • violation of third-party rights;
  • your instructions or configuration;
  • violation of applicable law.

This does not apply to the extent the claim is caused by Tulapp's own legally attributable conduct.


41. Force Majeure

Tulapp is not liable for failure or delay resulting from events reasonably beyond its control, including:

  • internet or telecommunications failure;
  • hosting failure;
  • infrastructure failure;
  • natural disasters;
  • war;
  • government action;
  • labour disputes;
  • large-scale cybersecurity incidents;
  • upstream-provider outages.

Mandatory legal rights remain unaffected.


42. Suspension

Tulapp may temporarily suspend access to hosted or account-based functionality where reasonably necessary because of:

  • security;
  • abuse;
  • unlawful activity;
  • non-payment;
  • violation of these Terms;
  • protection of users or infrastructure.

Where reasonably possible, Tulapp will provide notice.


43. Termination

You may stop using the Service at any time.

Cancellation or termination does not necessarily reverse technical changes previously made to your own website or infrastructure.

You are responsible for understanding and, where necessary, reversing or replacing any local configuration before discontinuing the Service.


44. Account and Data Deletion

Users may request deletion of their account and associated personal data subject to applicable:

  • legal retention requirements;
  • accounting requirements;
  • security requirements;
  • legitimate requirements for establishing or defending legal claims.

45. Changes to These Terms

Tulapp may update these Terms when necessary.

The current version and effective date will be published.

Where required by law, Tulapp will provide notice of material changes or request renewed acceptance.


46. Severability

If any provision is held invalid, unlawful or unenforceable, the remaining provisions remain in force.

The affected provision will apply to the maximum extent legally permitted.


47. No Waiver

Failure to enforce a provision does not constitute a waiver of that provision or any other right.


48. Assignment

Business users may not transfer their contractual rights or obligations without Tulapp's prior written consent unless applicable law provides otherwise.

Tulapp may transfer the agreement in connection with a merger, acquisition, restructuring or transfer of the relevant business, subject to applicable law.


49. Governing Law

These Terms and the contractual relationship between you and Tulapp are governed by the laws of the Netherlands, excluding conflict-of-law rules, unless mandatory law requires otherwise.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.


50. Mandatory Local Rights

The choice of Dutch law does not deprive consumers or other protected parties of mandatory rights that apply to them under the laws of their country of residence and cannot legally be waived.


51. Jurisdiction

For business users, disputes relating to these Terms or the Service shall be submitted to the competent court in the Netherlands serving Grote Sparrenlaan 3, 2121 CZ Bennebroek, The Netherlands, the registered location of ClickSmash B.V., unless mandatory law provides otherwise.

Consumers retain any jurisdictional rights provided by mandatory law.


52. Language

These Terms may be translated.

Unless applicable law requires otherwise, the English version is the primary version.

Where legally permitted, the English version prevails in the event of inconsistency.

54. Required User Confirmation

Tulapp or its software may require users to explicitly confirm certain matters before activating technical functionality.

These may include confirmation that:

  • these Terms have been accepted;
  • the user understands that technical changes involve risk;
  • a current and restorable backup is available;
  • the user is authorised to manage the connected systems.

Such confirmation does not transfer responsibility for the user's systems or backups to Tulapp.


55. Final Reminder

Always maintain a current and restorable backup before making material changes to your website or technical infrastructure.

The Service is designed to help improve and manage technical systems, but it cannot remove all operational, compatibility or security risks.

Use the Service at your own risk and only on systems you are authorised to manage.
